  • I think the bit from the CMA has been taken out of context. The page starts with "Where a contract is not performed as agreed, the CMA considers that consumer protection law will generally allow consumers to obtain a refund." The part the OP has quoted and the other subsequent paragraphs is clarifying the position in these cases. They are stating that this applies even in cases where a booking is non-refundable.

    In other words it is avoid companies trying to keep deposits and payments in cases where they are closed by simply saying it was non-refundable as some companies like Sykes were doing before the CMA intervened.

    I am afraid I do not see any easy answer here. The hostel was open and the room was available, I appreciate your concerns but I do not see any breach of contract on the part of the hostel and without that there is no claim against the hostel, or the card used to pay for it and I fear county court proceedings, apart form taking forever to get a hearing date, would just be a waste of money. You are one of many who have been caught out by something no one could have predicted.

    As far as understand the requirement to avoid multiple households sharing is advice only, not law. 
    How would the hostel know you did not all live together in one household normally. You could all share a house and go on holiday together. It is not the hostel's job to quiz its customers on their living arrangements.
