The Employment Appeals Tribunal in Pulse Healthcare Ltd v Carewatch Care Services Ltd & Ors (2012) determined that employment contracts must reflect the true nature of the employment. Zero hour contracts are meant to be a casual arrangement to enable employers to cater for changing levels of demand. However if a worker on a zero hour contract regularly works the same hours, then their employment contract reflects this, regardless of what their written contract states.
If the OP wants to go down the Pulse route, they have to use the internal grievance process and when exhausted, they then have to raise an ET within 3 months of the final decision.

The options the company has is to find work (if they have any) or to reflect the true nature of the position (i.e. redundant).

From some of the comments on MSE and from what can be garnered from other sources, there is a lot of pushing the employment law "envelope" either by dint of necessity, or poor management, or just outright bullying. The OP will never know unless they push back.
    • All land is owned. If you are not on yours, you are on someone else's
    • When on someone else's be it a road, a pavement, a right of way or a property there are rules. Don't assume there are none.
    • "Free parking" doesn't mean free of rules. Check the rules and if you don't like them, go elsewhere
    • All land is owned. If you are not on yours, you are on someone else's and their rules apply.

AGREED - you should call these things out.

although he has been on a zero hour contract, hes always worked three days a week, for 12 years
Yet another thread where someone on a ZERO hours contract doesn't appear to know what that means.

You might want to read some of the other more sensible responses which show that it is not a black and white situation.  And therefore your comment isn't correct or even particularly helpful.   Don't comment on things you don't really know anything about.
