I have messed up at the first hurdle

Hello,

ive read the newbies thread but I’m afraid I’ve messed up before I’ve even got started. 

I received a notice of debt recovery from DCBL, on behalf of parking eye. 

I stupidly (before coming here ) made the mistake of calling them (DCBL) for proof, because I don’t recall receiving the original fine. 

They have emailed me the notice to keeper that parking eye say they sent. 

I’m a bit stuck now and would appreciate advice.

    Email a SAR to Parking Eye to obtain the same paperwork plus all the rest of your data , email to go to their DPO attaching a copy of the V5C as proof of I D under the GDPR law

    Read the Newbies FAQ sticky thread near the top of the forum , dispute the alleged debt in writing as seen in post 2 of that thread , with dcbl themselves , telling them you have emailed a SAR to the claimant Parking Eye

    No blabbing about who was driving

    Study the SAR reply to see what if any errors have occurred

    Then wait for any Court claim pack from the CCBC in Northampton within 6 years

    i no longer own the car - so therefore no V5C. Also no driving licence (being updated) but I do have passport?

    No passport , no driving licence either , no further data to be given out than is necessary and a passport doesn't have the required information anyway

    Use copies of 2 recent redacted utility bills as proof of I D under the GDPR law , ensuring that the name , address and dates are showing , but redacting all the other personal information like references , balances etc

    You are proving that you are you at your current address

    Add a copy of this latest letter from dcbl too

    One more thing...

    If the NTK arrives late, this does not make the PCN 'void' but it means there is 'no keeper liability' possible.

    If they are a firm which alleges 'keeper liability' under the POFA 2012 (which they don't have to!)the a postal PCN must arrive by day 14 if there was no windscreen ticket.

    Or, the NTK must arrive with you between day 29 and day 57 if there was a windscreen PCN
    .

    i had no windscreen ticket, and it took 89 days to issue the ticket. Does this help or am I overthinking at this stage?

    That is why you check the parking eye NTK against POFA , as detailed in the newbies thread

    A windscreen ticket is rare in parking eye cases , as is a referral to a debt collector

    I suspect we can conclude that parking eye failed POFA that the Keeper has no liability and is why dcbl have the baton

    Just get your data and issue a rebuttal in writing to dcbl.  Then sit back and wait

    I doubt that parking eye will issue a court claim pack within 6 years

    We have never seen PE issue a claim after sending it to a debt collector. So no panicking!

    Nine times out of ten these tickets are scams, so consider complaining to your MP., it can cause the scammer extra costs, and in some cases, cancellation. 

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up later this year,

    Just as the clampers were finally closed down, so hopefully will many of these companies, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.
