Refund

Just before lockdown I was on holiday mid cruise to India but the port authorities would not allow us to dock. We were due to continue on land with a private  tour On 15th March. However as we could only dock in Australia On the18th March we were unable to commence the tour and had to fly home at extra cost to us. 
The insurance company is stating as the tour was a package it will not pay out. The travel agent is saying the insurance should pay out for curtailment of travel. We are in limbo has anybody got any insight to who we can get a refund from either the insurance or the travel agent

    It's the package organiser (who may or may not be a travel agent) who is obliged by the Package Travel Regulations to cover your costs of getting home and to refund the missing parts of the trip, so your insurer is right to expect them to do so.

    It may the travel agent or they could have bought the package from another operator. Check the information on your ATOL Certificate and see who it says was providing protection

    thanks for taking the time to reply I have checked my ATOL certificate and the travel Agent is the one providing the protection.
    so does this mean any refund should come from them?

    Yes if the travel agent acted as the organiser, it is their legal responsibility to refund, Many have had problems recovering money from suppliers but if they do not respond, as they are the contracting party you may be able to request a chargeback if you paid by card
