AARRGGHH!! Help Please ........

Hello everyone,
Well the saga of my house sale / purchase continues. Basically 4 weeks ago we were told that exchange was only a few days away and we all set a moving date for 26th November. We then had a call to say that the second person in the chain would have to delay exchange for about 3 weeks. So I call my solicitor today (3 weeks later) to be told that it appears that the 2nd in the chain is having to get a charge removed from the property before she can proceed (bankruptcy charge was mentioned). It has already been 3 weeks and nobody can give us any idea as to how much longer it will take. Has anyone else had this happen and how long did it take to sort out? I am at my wits end as the chain originally formed late june early july and six months later we are still here. The solicitor is confident that it will get sorted but just kept saying that as it was a legal matter it would take time. Am really fed up.......

nightmare, we once had a chain where someone couldn't get a charge removed and ended up pulling out of the sale!

Your answer is, how long is a piece of string?

If it is a charge connected to bankruptcy then either the official receiver has registered their beneficial interest in the property and will have to agree the sale or someone has bought out the OR's BI and they have to agree the sale.

Both could be a short delay or could cause problems if the money they take out doesn't leave enough for the seller to buy the property they had planned in the chain.

  • well from what we've been told (whether its the truth i honestly dont know) the person is going to buy their next property (our buyers house) with cash so i assume that there is enough money. This particular buyer joined the chain in the second week of september and its just so frustrating that this has only come to light now. once this move has happened i am never going to move again!!!! lol

I empathise with you completely. I accepted offer on my house back in May & having been led last week to believe everybody in chain now ready to exchange & complete a week before Christmas, I today find that exchange hasn't taken place & nobody has any idea exactly when it will. Vague mutterings about somebody at the bottom of the chain & their deposit.

To be honest I've practically given up any hope now & am just going to fix it in my head that the whole thing is going to fall apart, as the stress & anxiety of the whole process has me almost falling apart & needing a straight jacket. Christmas on the psychiatric ward methinks.
The bigger the bargain, the better I feel.

I should mention that there's only one of me, don't confuse me with others of the same name.
  • sorry to hear that Cattie. This house selling/buying malarkey is the most stressed out i have ever been. But until i hear otherwise i am going to stay positive (well try to anyway) that this bloody move is eventually going to happen. But i have relented and told the kids that we can put the tree up either today or tomorrow as they have been busting to do it and i kept saying 'lets wait just in case we move before christmas'. yeah right! lol
