Paid Ringo on Ringo App for wrong car park - Any advice

Hi can anyone help? 😞I parked on a NCP car park and mistakenly used the Ringo app, did this 4 times. It later transpired that the NCP car park in question does not use this app but the location services picked up a nearby council car park, which it turned out I was actually paying for. I now have got myself 4 x NCPs!!
i have appealed the first one and lost (even with proof of intent to pay) I have now paid it but could I still take to POPLA.
Any advice on appealing the remaining 3 pcns ?

    You are very likely to stuggle at PoPLA, but if they take the matter to court a judge may see things differently as nine times out of ten these tickets are scams, so consider complaining to your MP., it can cause the scammer extra costs, and in some cases, cancellation.


    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up later this year,

    Just as the clampers were finally closed down, so hopefully will many of these companies, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    You can't use POPLA if you have paid the charge that one is done and dusted. You are going to struggle with this now the fact you paid for the wrong car park is your error, I never take the positioning of my phone to give me the car park location I always use the reference number on signage.
    The only way to attack this now is to follow the advice on the newbies thread and appeal using the first appeal already written for you and then go to POPLA, But stating what you did and how you paid for the wrong location / intent to pay argument will not cut it.

    FJ is right, you need to find an error or weakness on their part, contract, timeliness, abuse of process, signs, etc.  The newbies thread is the place to start.
    You never know how far you can go until you go too far.
  • Ok, thank you. It’s been mentioned to me that the ticket coming after 2 weeks might hold some weight but I can’t find anything to really back this up. Do you know anything about this?
    Ive a feeling this is going to be a very expensive mistake.

    Have you read the newbies thread?
    The 14 days youre thinking of relates to POFA2012; where no notice is on the car they have to get the NtK (postal PCN) to you within 14 days. If they dont, then as long as the driver is never identified to them the keeper - YOU - is not liable for the charge. 
    So you appeal to NCP, and then appeal to POPLA on the basis of failure to comply with POFA. 
    DONT just pay up

    NCP are almost totally scared of court (they lost £30k illegally towing someones car, and since then have dipped their toe half a dozen times, max) and are utterly incompetent when they do try it.

    This is covered in the NEWBIES and refers to the strict requirements of the PoFA 2012, the only law that can make a keeper liable. There is a link to the PoFA in the NEWBIES or you can find it on the internet by using a search engine of your choice.

    Acronyms and abbreviations are in the 5th post of the NEWBIES. I suggest you print it off or write them out.

    The basics are, for a windscreen ticket (NTD) the NTK must arrive between day 28 and 56 for keeper liability to apply.
    Where a NTD has not been given such as where ANPR scameras are used, the NTK must arrive by day 14 for keeper liability to apply.
    In both cases the date of the alleged event is day zero.

    The above is the reason why the driver's identity must never be revealed in most cases.

    Use the template in blue text from the NEWBIES and add a one liner to say that the NTK has arrived too late for keeper liability to apply, so they should cancel the charge now and save themselves money.
    Read up on what to do next if the charge isn't cancelled.
