Seventh Anniversary First Post Combo Breaker

I have a package holiday to Tenerefe booked with a tour operator 6th August. I have an Email from hotel confirming it is closed at least until 10th August. My request on live chat for refund was ignored. I believe i will be offered alternative hotel but not until a 5th August. Can I refuse alternative and what do i do if they refuse to cancel holiday.

    More than likely the terms and conditions of the company (which company?) will clarify what they can and can't do, go and have a read of them.

    T & Cs say they have to give me 7 days notice but still my choice to accept or get refund. As per consumer rights 2018.

    In which case I would expect them to contact you within the next few days to clarify your travel plans (I appreciate in practice this might not happen!)

    What exactly is 'consumer rights 2018' that you're relying on? There's nothing specific in consumer legislation that entitles you to a cash refund if your hotel is closed but they can find you an equivalent alternative. 

    Their T&Cs normally entitle them to move you to a similar hotel in the same resort; if they do state this, then you'll have to accept the swap.

    The operators T&C's will fulfill their obligations under the law.
