Wayleave Payment

Hello, sorry if I have put this in the wrong place.

I have had a letter from Sherwill Drake Forbes. I have a power line post in my garden, and they say the energy provider for the area should be paying a wayleave payment, to retain the apparatus on my property. It continues that over the years, rates have changed and wayleaves have expired. They then say they have agreed a process to rectify this on behalf of clients, and they can set up appropriate payments with the energy provider. They will take 20% commission and VAT.

I have never heard of this wayleave payment. Am I able to receive this and can I do it alone or would it be better through a provider like this?

    Good advice.  I negotiated directly with SSE over mine.  It's a very easy process to do it yourself, and not have to part with 20%!

    If the pole carries power to your house only then they won't pay anything for it being on your land.
    If the pole carries power to other properties then they should be paying something, unless a previous owner agreed a 'lump sum' buyout agreement in exchange for the pole to remain in perpetuity.
    I have examples of all three on my land.
    The two poles that do get paid for bring in the mighty sum of around £30 per year.

    A wayleave agreement with a previous owner is just that. If there is an easement in place that is a different matter

  • How did you get on with this?
    Am interested as we used to get a payment from EDF (now UK Power Networks) every year of about £40 but we haven't received a payment for a couple of years. Have taken this up with them and they are now looking to pay half the amount! Smacks of a Company who makes millions in profits, just trying to make even more money so I have asked them how we go about getting post removed from our property and am waiting for a response!
  • Hello. I have received a payment from Scottish Power. They said they can pay every year or pay a few years in advance, so I chose the second option. They also paid me for the previous six years. I'm not sure about the post being removed, but hopefully they will let you know.

    Apologies for jumping on someone else's post but as it is related I thought this would be the best place to put it.

    We have lived at our address for 15 years (from new build) and have never made any claim but earlier this year we had a letter from someone offering to put a claim in on our behalf but on the back of this post I contacted SSE directly.  It has taken a while (they say they have had a backlog of claims) but I got a response today and they are offering either:

    1:15 year term agreement at £150 as a lump sum until February 2036 and then it will revert to an annual payment of £2 per year.
    No back payment with this option.

    or 

    an annual payment of £2 per year but a back payment of up to 6 years.

    I think the first option is the better one and obviously this is effectively free money so I shouldn't gripe, but are these figures appropriate?  The cables we have are underground (I wouldn't have known they were there had I not got the letter from the company offering to make the claim for us!)

    Any guidance would be appreciated.
