I am very sorry to hear of the position your friend is in. If counselling will help Cruse might be able to offer some support https://www.cruse.org.uk/get-help
As well as dealing with the eviction threat, as your friend refused a tenancy at the place because of his lack of income, has anyone helped him look at options? How old is the daughter? Can she contribute? If he did have a TA.., would he be able to apply for HLA so could pay the rent (how big is the house, he'd only get HLA for a two bed place if its him and his partner's daughter).
If this isn't a possibility, plans need to be made as to how he can move to another more affordable tenancy. While this eviction attempt may not be valid, eventually the LL will obtain a possession order.1 -
Hi jenflint, I echo the suggestions already given. The law is supportive enough of your friend that they will have time to decide on a way forward.
It may also help if you can give us a sense of what position your friend would like to get to after this situation is resolved? It sounds like they do not want to stay in the property long-term. They should have time to make plans and we may be able to provide more suggestions in this area.
Also, who is the executor for the estate of the deceased, and who are the beneficiaries? Do you know? The estate will have to eventually keep paying for the tenancy in theory - will there be anything of worth in it?0
