Caravan park refund

hi Martin and All
I'm an ower of a caravan and the site have issued an email stating that we are not getting a refund even though the site was shut from March until 4th July. As part of our site fees we pay for the entertainment and the attractions and amenities, obviously we have been unable to use these are they in there rights to not issue a refund or discount from next years site fees?

    Yes they are within their rights, especially if by doing so (to you and all other customers) it could tip the business over the edge financially.

    The financial success or failure of the park has no bearing on "rights". It will be down to the terms agreed in the licence.

    The main trade association for these parks is the National Caravan Council and on that site there is a link to Consumer Advice. You might want to read it.

    • All land is owned. If you are not on yours, you are on someone else's
    • When on someone else's be it a road, a pavement, a right of way or a property there are rules. Don't assume there are none.
    • "Free parking" doesn't mean free of rules. Check the rules and if you don't like them, go elsewhere

    What about the "right" of the caravan site owner to have a business to continue operating once all this mess is over?

    The OP stated they had paid for their site fees in advance and, presumably, their caravan was parked on the site throughout.  Using that logic, why are they not also pushing for a refund from the site because they were not able to use their caravan during lockdown?

    The OP appears to be reasonable in only asking for a discount to reflect those elements of the service that have not been provided, namely the entertainment, attractions and amenities.  The OP's "rights" in this regard are as set out in the contract between him and the caravan park.

    Good idea, let's send huge numbers of small businesses to the wall over minutiae.

    I ask again, as the OP is requesting a refund for not having access to entertainment, why is he not also asking for a refund for not having access to his caravan?  The two are interlinked.

    I never said anything was a good idea - merely stating the facts.

    I cannot speak for the OP.  Maybe they recognise that they still got some value by having the caravan on site and the site was not to blame nor made any efficiency by not allowing access.  With the other items, it is reasonable for the OP to expect the business will have controlled their costs so the savings can be passed back.

    Hey, maybe, as you seem to want, the OP should make a massive claim and drive the business over the edge.

    If a business agrees to provide t, u, v, w, x, y and z and the customer pays for t, u, v, w, x, y and z, but "w" is not provided it is only fair that the customer is refunded that element of the charge or fees
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

    Unless you know the actual financial state of the business it's impossible to pass any judgement. The business no doubt relies on more than just site fees to generate revenue to operate.
