Once your mother passed away, which we are really sorry to hear about, any claim for alleged debt has gone as well. They cannot file a claim against someone who has passed away, and as there is no actual debt they also CANNOT claim against her estate.
Instruct them to cease and to close down, as they have no prospect of success and any further communiocation is distressing and harrasment

My mum passed away in November.  A letter before claim addressed to her arrived from Gladstones last Friday
Sorry to hear of your sad news. A LBC does not require an AOS (only a formal N1 claim form from the Northampton CCBC requires such a response).

I would send Gladstones (not DE) a simple letter saying that you have been opening the mail of your late mother and have found their correspondence to which you are now responding. As your mother has sadly passed away their letter will receive no further response; here is a copy of the death certificate for their information.

Then see how they reply. Keep it simple at this stage. Come back if they play stupid. And again, sorry for your loss.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Why send them a copy of the death certificate?   Surely they can obtain one themselves for a fee?  It is not our purpose to make life easy for these crooks.

I am trying to make life easy for the OP!  Gladstones (and DE) seeing the potential for £800 slip through their fingers on the back of a photocopy of the certificate will be pain enough for them.

You're sitting on the awkward step this morning @D_P_Dance! 😂

Yep, send a copy. It is the reasonable thing to do.

Agree with the above, copy of death cert and a covering letter, saves problems down the line

So sorry to hear your sad news.  Hope you are coping OK.  If you get any issues with this being cancelled, reply here again and I will flag it up with the IPC, who you said before were ignoring your emails after Dyl Kurpil swore at you.  Did he do that by email, can you show me my pm please?  I have good reasons for asking.  I am  listened to by both Trade Bodies regarding certain cases and yours is ringing alarm bells that it needs cancelling immediately.

  • Thank you all so much for your kind words and sound advice. It is a huge relief to hear that they have no further basis for a claim. I have emailed Gladstones and hopefully that will be the end of it.

Not me thankfully, but it was around the same time, I remember seeing the thread. I have not had any contact with DE other than carbon copy automatically generated letters and emails.
