Moorcroft debt recovery ltd.

Ive just gotten another letter off Moorcroft asking me to repay the money i owe to them,which was originally a debt of £3000 with my bank( shatwest!). I admit i havent made a payment since July but i cannot afford the £120 a month they are asking me for.They said if i dont make the payment by the 10th of this month i will have court proceedings started against me.The thing is i have been off work sick for the past two months and my girlfriend is expecting a child in march.I am due to go back to work in January,which is a good thing.There has been so much else happening including paying maintenance to my ex for my two kids,paying for a divorce(solcitors etc) and also other things.What really annoys me is that im currently another waiting for the result of the court case about bank charges,because if it is deemed illegal,Natwest owe me £4000!

Can they really take me to court? and threaten me on the phone etc? I offered to start paying something weekly but i dont have the money they are talking of.

Will Payplan be able to help me?

Any help is appreciated.

    They could take you to court, but the thugs at Moorcroft know that, if they do take you to Court, the Court will not make you pay more than you can afford. In a way, Moorcroft would be doing you a favour by taking you to court, because you would have the chance of explaining your situation to a judge, who would make a payment order that would be within your means.
    The bullies from Moorcroft would be just as bound as you by any such court order and could not, legally, harrass you to pay more.
    So, stick to your offer - they are really trying to push you into making a commitment that you can not afford.
    If you are still worried, have a chat with one of the Debt Counselling Charities, such as CAB, Payplan, CCCS or National Debtline - their advice is Professional, Free and Confidential.

  • Hi there i would call thier bluff and say fine you will have to take me to court as i cannot pay what you are asking however i can pay x per month. Put it in writing and also ask them in the letter not to call you any more and you will deal with them by post only.
    Make £11,000 in 2011 / ebay £600

    Moorcroft are evil!! I had sp many problems with them before going BR. They CAN take you to court but as Rog says, they would not be able to force you to make payments that you can't afford...plus, you have offered to pay them what you can weekly which will help if you go against a judge.

    A few people i know have gone off to the CAB and they have helped them devise a letter saying they will pay a token £1 per month until they can afford to pay them more, which in your case, sounds like it would be in Feb at the earliest?

  • Are Moorcroft allowed to bully people over the phone???

    I've just come off the phone to them after telling them that I can't make a payment until the end of jan 08. I left my job in Oct due to stress and am not starting my new job until 2nd Jan 08. The guy that I spoke to wasn't interested in helping me set up a new payment plan, instead he just threatened me with bailiffs and court action!!!!!!

    The thing that has wound me up is that I'd already spoken to 3 other companies and they were happy for me to start making payments in January. So why the hell can't moorcroft be the same as these??????
  • I've had dealings with Moorcroft, :mad::confused::eek: Be strong and don't let them get you down, I found not getting emotional with them helped, they just got nastier

    Have you considered asking the Citizens advice Bureau to deal with them on your behalf.All my debt collectors, including Moorcroft , have been a lot less intrusive since I got the C.A. B on my case-but I do have severe clinical depression, and other mitigating circumstances, which I think C.A.B have asked them to take into account when dealing with me-so it may depend on your circumstances. Still , worth a shot?

    I fear that I'm going to regret this, but...I've never had any problem with moorcroft. Could just be me, 'cause I won't stand for payground bullboys.
