    My MIL died in May, we sent off her prem bond cash in and they recd it on the 10th May, written conf of this recd, as well as the death cert, power of attorney paperwork returned, but now almost 10 weeks later still no payment. 

    I wonder does the OP have PoA for his FiL so is dealing with matters on his behalf?

    Not sure why probate should be complicated for nsi. It’s hmcts who give probate. If you have either probate or letters of admnistration then NSI just have to follow that.
    nsi are 6 weeks behind on their post due to covid.
    has the proper bereavement form been sent in?
    if it’s a lot of money then probate will be required so best to get on with that rather than wait a few months for NSI to tell you that you need probate.
    they have discretion. But their limit is around £5k so if it’s way over that the. Just get on with probate.

    The only way I've kicked NS&I out of their self-satified torpor is to complain to H.M. Treasury - NS&I's bosses.
    Still takes weeks, but they do force actions out of NS&I.
    From a recent email of mine to:    public.enquiries@hmtreasury.gsi.gov.uk
    "Dear Sir or Madam,
    As National Savings and Investments describes itself as "both a government department and an Executive Agency of the Chancellor of the Exchequer", HMT seem to me to be the right body to drive NS&I to act in a responsible and timely manner." etc. etc.

    There have been so many threads about NS&I , many of them complaining. My advice is just to go to another saver if you don't like NS&I.  Personally, I have used them for many years and will never stop doing so. But, IMHO others who just moan, should really think about alternatives to NS&I instead of complaining on these Forums.

    Like you I have only started to use them late last year,  opened my account for PB and Direct Saver online and had no problems whatsoever
    I had problems transferring some money from Direct Saver to PB, made a call, had to wait a while of course, because of the staff situation (COVID), but the lady who dealt with me was very nice and professional.  I had everything sorted and she explained where I was going wrong.
    People seem to forget that the whole world have gone through and still going through this virus situation that none of us have encountered before.
    Everything now is taking twice, three or more to get done, this is something we have to live with no and post corona virus
    Just because one send off something, it does not mean that it is going to get done straight away, there are people who have been waiting before you.
    Writing to HM Treasury and the Financial Services Ombudsman is not going to make sure situation so go any faster, in fact they probably laugh at the complain, whilst  send you a generic reply.

    You may have a valid point but it is not pertinent to this thread. The OP has not chosen to invest in PBs but has a need to withdraw funds invested by their deceased mother in law.

    Power of attorney is irrelevant as that ends on death.   It is the executor of the estate that takes over the administration.

    Is there probate?   Is there a Will?

    Its a 2 way thing, the govt wants our money but at the moment wont give is it back. I have an 86 year old FIL sick to death he'll be taken to court over his wife's funeral bill, through no fault of his own.

    The funeral bill can be paid from the estate, if any liquid funds available.

    We have had several probate cases in the last couple of years that took longer than a year.  Usually, probate cases are measured in months rather than weeks.

    OP, that is truly shocking. Please keep us updated.

    Its not shocking.    It may have passed you by but the country was in lockdown at the time and administration had slowed to a crawl.  The OP has given very limited information and we don't know all the circumstances.   The supply of power of attorney information and a death certificate is conflicting information.     We need to know more before making emotional statements of "shocking".

    I am guessing but it's possible that the plan was/is to pay the funeral bill with the PB money.
