My sisters boyfriend took credit and store cards out in mine and my husbands name

Hi Martin,

Nearly 4 years ago I went to open up a new Bank Account and was rejected, due to a low credit rating, which I was not aware of as I maintain regular payments on time to anything I pay out and have no debt, other than student loans. As the branch officer encouraged me to look into what was affecting I discovered that there was countless loans and catalogues taken out under my name, all of which have not been paid back!

I then recieved mail, I noticed a letter of debt from a catalogue company which stated I owed them a LOT of money, and upon further investigation found out that it was my sisters boyfriend at the time, who has been taking all this credit out in my name and some in my husbands. He had racked up an enormous amount of debt in mine and my husbands name, leaving us both unable to apply for credit in the nearby future, and also has affected my chances of getting a car on finance, which has got me extremely furious and made my on going medical condition ten times worse. I reported it to action fraud and sent to the police who gave me police reference numbers ect, but they said they couldn’t arrest him and take it further.

4 years down the line I now have two credit card of my own with just under 2000 to pay back and I all I want to do is take out a 0% interest credit card so I can swap both on to that to avoid paying the interest but due to him taking out 4 store cards and more credit cards my credit history is terrible and won’t let me do this. Can you please help me as k have always payed my credit cards on time ect and never had a bad score until he did all this to us. I honestly thought this would be over now but we are still living this nightmare. We both have really good jobs and o problems with money but we are just not being given the chance to do it after all this time.

Any advice would be appreciated, as my husband would like to take a car out on finance through work and he’s not even being given the option for that :(

Thanks Rachel

Your only option was to report it as fraud to the various lenders, but that ship has probably sailed now.

The accounts will drop off 6 years from closure or default. Have you checked your credit files to see what appears?

It sounds as if you have wider problems than the fraudulent accounts though if you are struggling with a 2k debt.Go to the DFW boards and post a SoA. You need to find out where you money is going.  You're not going to be able to get a car loan based on affordability by the sound of it.

Get CIFAS registered. Tell your sister her boyfriend is a scum bag and fraudster.
Speak to all the loan and debt companies that each account is fraudulent.

If you reported each of the accounts to action fraud, and the police, and have the crime reference number as you've implied in your post - forward the details of these to each of the account holding companies with a straightforward letter along the lines of:

    To whom it may concern,

There is an account from your company recorded in my credit file, allegedly opened on XXX date, and currently has a balance of £XXX outstanding. This was a fraudulently opened account as reported to the Police and Action fraud on XXXXDATE. The Police reference number for this incident was XXXX. Please check this as being correct, and then please remove all history of the account from my credit file.

    Account name: XYZ Catalogue
    Opened: XXX date
    Amount outstanding: £XXX
Date reported to Action Fraud/Police: XXX date
    Crime reference number: XXX

    Regards

You let him off 4 years ago - did you speak to a solicitor after the police?

Did you repay the debt that he racked up or did the lenders accept that this was not your debt?
