Builders have reneged on property reservation

I have paid a reservation fee to a large national builder on a property. The property had previously been reserved by someone else who withdrew from the property and we had to wait until the reservation cancellation had been confirmed by the builder and they had been refunded their reservation fee before we could make our reservation fee. After 3 weeks and having paid our reservation fee, we have now been told that the previous people who reserved the property have now changed their mind and still want the property and that we are no longer entitled to the house. We have been told by the builder that the previous people have legal rights to the property. Can you tell me if this is the case?

Rubbish.They either never pulled out or they offered more than you did.Everything that is supposed to be in heaven is already here on earth.

Read your reservation agreement. Mine says "We (the developer) agree not to re-offer the property for sale.......provided we are satisfied you use all reasonable endeavours to proceed." So if you have a signed reservation agreement with wording like this in it, they should not be doing what they have done. If you don't have a signed agreement with wording like this, you probably can't do much about it.3

I assume they're refunding the reservation fee.
What do you want? Them to be somehow forced to sell the place to you? There's other houses. Do you really want to give this bunch your business?0 -
