Bearing in mind I've paid 626 to the current loan they want to deduct my 530 refund off the balance. Which leaves my balance at 689 which takes me back over to the original loan amount of 1300.. coincidence or not? Should I highlight this before going to the FOS?

No, I would just go straight to the FOS - you have received an offer which you are not happy with so just politely tell them that you will be taking this to the FOS. This may trigger them to make a better offer that you are happy with so you can always cancel your complaint with FOS if that happens.

  • Thank you so much for your reply PartyPoison.

I do have the link to debt camel saved on my laptop. I just wasn't sure if we could proceed as he still owes them some money.
We will request his account details tomorrow and will update as and when any progress (if any progress!) is made.

No worries. I would treat the two separately for now, as I said its a long process (especially with Wonga from my own experience) so as long as you do nothing wrong (i.e. repay what you need to or at least what you can) so that they dont have anything to use against you then you should be able to progress.

I've just come across this thread and looking for some advice from you guys who have had success.

I've taken out payday loans sporadically over the years. I have had 1 in the past where they were chasing relentlessly for payments I couldn't make and that was referred to the Ombudsman who told them they had to cancel and refund the interest and charges as I shouldn't have had the loan.

I have rolled loans over previously where I was borrowing to repay others or just couldn't make the payments that month.

Recently I have taken them out and managed to repay but by going into overdrafts or using a credit card to cover day to day stuff (a mess I know!).

I wondered, can I still go back to loans with them from years ago? Do I just write to the companies stating that I couldn't afford them? Do I need to provide account details for the loans because some I cannot remember. Any help or guidance would be great.

Once I accepted my offer, I had a confirmation email saying "Please note that it can take up to ten working days to process your settlement and that the payment is issued via Faster Payment." While I'm not saying they WILL pay in 10 working days, they have now set my expectations there so I will be complaining if they don't. Also, 10 working days would be 14 standard days so maybe you will get yours today - or did you not get that same email?

Did you have to go through the FOS to reach a settlement......might be different timescales if you use the Ombudsman and if you don't?

I would suggest they are offering you a token sum, but just enough that you might accept and go away so to speak.

Best way to go with this would be to get a statement and follow the advice on Debt Camel - https://debtcamel.co.uk/payday-loan-refunds/ they can review older loans so its always worth a shot.

No, this was with the company themselves, I didnt need the FOS for this.

Think that must be the reason why.

Either way it worked - the money ended up in my account Friday night so all food on that front. Just waiting on one last one to bother replying now but its the smallest amount from the 3 companies I used.
