Parking ticket for rental car 5 months ago. Received 1st letter now.

Hi everyone, 
I did read the newbie thread and many other threads, and I don't consider myself to be too thick, but here goes:


  • I just received a letter from QDR Solicitors, instructed by ZZPS on behalf of CIVIL ENFORCEMENT LTD informing me that I have 14 days to pay £182
  • This came 5 months after the supposed parking violation, at an open parking lot at a hotel
  • The car in question was a rental car
  • I never knew about the parking ticket, nor have I received any letters about it until today
 
I realise from the many threads here that they have no power and that I should ignore them. However, I do have several questions:
  1. Is it common for these cases to reach court? Meaning, if I do nothing, will I be prosecuted for sure?
  2. I'm moving soon. How do I make sure I don't miss a court hearing if I'm sent one? Can I update my address?
  3. Is there anything at all I can or should be doing in this situation. I'm guessing it's too late for an appeal?

    1) yes it's common to be taken to court , especially in the last few years since the Beavis case , especially by CEL , like this thread

    Nobody will be prosecuted , it's a civil case , not a criminal case

    2) you email a data rectification notice to the DPO at the PPC in question

    Also email a SAR to the same DPO attaching a copy of the V5C or 2 recent redacted utility bills as proof of I D under the GDPR law

    3) too late for any appeal but never too late for a landowner cancellation after a complaint is made

    Assuming you were resident at or had business at, the hotel, I hope you have written to them to ask two fundamental questions,
    1.  Why have they infested their car park with a PPC, which is surely going to drive away custom and neither you, your family nor your friends will ever use that hotel again?  See, they've already lost business!
    2.  Why did they not have plans in place to protect genuine users of the hotel?

    QDR are just ZZPS using their notepaper - it's a debt collector letter.  I was going to say ignore them but I would actually reply and say to QDR that you were the hirer/lessee of this rental vehicle but no Notice to Hirer was ever served to you, and why is that?  And how do they believe their client can rely upon the POFA re hirer liability if they haven't complied? 

    DO NOT SAY WHO PARKED/WAS DRIVING.

    The above is IMPORTANT to stop them reverting to the rental firm!

    CEL issue their own claims (and lose them, and drop them, when up against a forum-assiste defence and witness statement/evidence!).  It's CEL you need to update with your new address asap when you move.

    Nine times out of ten these tickets are scams, so consider complaining to your MP., it can cause the scammer extra costs, and in some cases, cancellation. 

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up later this year,

    Just as the clampers were finally closed down, so hopefully will many of these companies, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.
