Started claim within deadline - does it count?

Hi all, just looking for some advice although I’m pretty sure I can’t claim...

I contacted the claims guys in 2017 re PPI I thought I might have paid on an MBNA credit card it applied for in 1998 - I was pressured into applying at my university graduation ceremony so pretty sure it was mis-sold.

MBNA came back and said they had no record of my account so they needed an account, but my card was long gone and I couldn’t find any details so had to leave it.

last week I found a statement in an old diary with my account number and PPI payments itemized.

Does my starting enquiries about this in 2017 mean I’ve got in before the deadline? Obviously, I’m not optimistic that it does though I’m pretty annoyed that MBNA said they had no record of me when they must have done, seems a good way for them to have got out of paying me what was owed. I know Plevin doesn’t apply to me as I’d closed my account by 2008.

thanks for advice!

If your registered a complaint before the deadline, then you could provide the additional information.

However, the problem is that MBNA said they had no record of you because they had no record of you.  It's not a case of getting out of paying what was owed - particularly as there is no evidence that anything is in fact owed.

So it will all hinge on what information you can provide and whether they uphold your complaint reasons.

Why do you think they must have had records?

I know Plevin doesn’t apply to me as I’d closed my account by 2008.

It also means they probably destroyed records around 2014.

Companies are not required to keep your records to infinity and beyond just because you happened to bank with them over 12 years ago. They are required to keep as long as necessary or a recommended six years. Since you don't bank with them and had shut your accounts before 2008, not a surprise they have nothing left.
