This friend of mine is a private individual, simply trying to make a few extra ££'s in lockdown
That is the basis of a business. You buy something for £20 and sell it for £25, you have £5 profit, and that is the world of trade.
Absolutely. And if there is a subsequent problem with the item, you also carry the liability for correcting it. The potential costs of doing so need to be factored in to your business model - along with any agreements with your supplier as to what support they will provide to you.

I think this might be the same group as previously, but there is a new thread about lazy spa declining a warranty claim as the tub was bought from eBay and seller was not an authorised reseller

it confirms that the warranty is not transferable. However as above that doesn’t take away consumer rights which lie with the seller and not with the manufacturer.

I frankly think this is ridiculous. How on earth can the seller be responsible if something goes wrong..? The Manufacturer makes the product and warrants against faults and defects. It is their product and responsibilty if something goes wrong. "authorised reseller" or not. I cannot for the life of me remember a company trying to abscond from their responsibilty in a greater way. Pretty much every single product for sale on the market now a days is warranted against defect or fault, for a minimum of 12 months regardless who does or does not own it.
    It isn't ridiculous.

Your warranty is completely separate and is 100% up to the giver of the warranty as to what the t&c are.  If the warranty giver says you must register the warranty and attach a photo of you in the spa, then that forms part of the contract of the warranty.  If the warranty says the warranty can only be registered if the product is purchased from an authorised reseller, then this forms the contract of the warranty.  A manufacturer does not have to give any warranty at all, not even from day 1.  It is entirely possible to buy a brand new item from a bonafide company and it have no warranty whatsoever.

There is separate legislation in the UK to protect buyers.  The legislation covers the transaction between buyer and seller.
  • Im not sure that the seller bought it to sell on. I assumed he bought it, hasn't got around to using it, so decided to sell it along  with anything else of value. I still don't understand how they knew it was bought by someone else though, unless you told them.

If you read the thread OP states clearly that his friend bought these to resell to make a bit of extra money due to the impact of COVID-19 on his usual business.
