@Twinklefairy - you've done your homework well, nice one. As there is no mention in your detailed post of paying any fee for making a counterclaim, I just wanted to check that you are aware that for a £500.00 counterclaim, a fee of £35 will need to be paid to HMCTS?

Yes - I did know I have to pay a fee, when I submit my defence by email is there a way i have to pay the counterclaim - someone else i know did their defence online so they paid the fee when they submitted their defence and claim

that is what you will do too , all at the same time with the appropriate fee

if no counter claim is done , the claimant could discontinue after putting you through the wringer first , which we see a lot on here

I thought I needed to email in my defence as it is too many lines to do via MCO online. Do i do it via gov.uk - make a money claim online once i have submitted my defence by email.
Guess no harm in doing a counterclaim, better to think I could get something at the end of all this situation.

Please read @KeithP's advisory post from last evening (22/07 at 9.55pm) - it guides you (and links you) to the NEWBIES FAQ sticky, second post, which tells you how to submit your defence.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

yes you will be emailing your defence to the CCBC, plus your counterclaim as well and paying the fee at the same time (I have never done it but it must be possible to do both, or email both , or whatever the CCBC require)

do not fill in the defence box online, that is a no no

I'm sorry I have searched the newbies threads and various other threads and there is nothing referring to making a payment for counterclaim when emailing in your defence, unless I am missing something. If there is information please can someone link how I pay for a counterclaim which is detailed on my defence which I will be emailing in. Do I need to make a new claim on MCOL online against VCS for the counterclaim - maybe ?

I doubt there is anything on here about submitting the actual counterclaim with the defence, I have never seen it anyway , most people refer you to that newbies thread for defending your claim, not for making one or counter claiming, whereas you are doing both

Umkomaas did direct you to the MCOL website where all manner of questions are answered, because its nothing to do with parking, it could have been a dispute over shoddy goods or a tenancy gone wrong etc

if you login to MCOL online you will see the various boxes including the AOS option and somewhere in there is the option to counterclaim AFAIK , or you email the counterclaim document with your defence document ?

I dont understand why you are not consulting the MCOL website for this counterclaim option ?

You simply email your defence to the CCBCAQ usual email address, with the counterclaim under a subheading but following straight on from the defence and make sure it's signed & dated under a (April 2020 version) statemement of truth at the bottom.

In your covering email and the subject line add 'CLAIM NUMBER XXXXX - DEFENCE AND COUNTERCLAIM' and in the body of the email give your phone number and ask the CCBC to call you to pay by card over the phone for the cc.  Ring them after 48 hours if they haven't rung you.

But don't submit it yet; your draft is too weak. Send me a pm as I have a template counterclaim example that I don't want to post yet here because it relates to a similar case in hand right now.
