should my warranty be honoured?

The moped is under a year old, when the moped as at about 500 miles I was going to take it to the garage because that's when my warranty dictated it was due the 1st service, Coronavirus hit resulting in the garages closing down so I couldn't do the service but as a keyworker(Healthcare Assistant) I still needed to get to work so carried on riding... a few months later when I pulled up to traffic lights the engine cut out and the moped wouldn't start so I parked it up and got a taxi to work. about 2 days later I collected the moped from the roadside and it was able to start again but figured there was something seriously wrong with the bike and the garage had just opened so took it in and by this time the bike had about 950 miles on the clock and found out the repairs will cost me about £350 and the manufacturer is refusing to honour the warranty due to the bike not getting serviced at 500 miles... this was the email they sent me
'After investigating the case and double checking the registration of the bike with our warranty department, I can confirm that your warranty has been void.

 

Unfortunately, whilst we are quite flexible during this period, your bike should have the first service at 311 miles/500 km, however you are now at the mileage where the second service is due (932 miles/ 1500km). Regrettably whilst the virus situation has caused lots of difficulties for consumers and dealerships alike the service schedule still has a purpose. By disregarding the service schedule you are using the machine in a way not recommended by the manufacturer and so we are unable to support further the vehicle. We are happy for the owners to access any Lexmoto dealer or VAT registered mechanic for assistance which could have accommodated. Also I am unable to locate any previous correspondence from where I can see that you have tried to contact us regarding this, before breached the warranty terms.

    You've quite simply missed the first service out completely, and are at the mileage when the second is due, three times the mileage the first service was due.
    They have no record of you contacting them to ask what you should do, hence you not finding out about the contingencies they had in place.

    You don't say what the issue with the bike was, but is it something maintenance-related? Lack of oil, or...?
  • Probably one of the only things that would be carried out on a service at 300 miles from new would be an engine oil and filter change and as the moped is probably fitted a fairly low tolerance engine that will burn a bit of oil, this may well be fairly important hence the reason for their requiring a service at such frequent periods. (initially at 311 miles / 6 weeks & 932 miles / 4 months)
    The Lexmoto website does state that you can have the service work carried out at any VAT registered garage and I'm sure that there were plenty of these still open during the park Covid period.

    Given that the bill is apparently £350, and the Lexmoto moped range starts at £1,100 list, I rather suspect we're talking about a new engine having run out of oil...

    If that is the case, then not only would the 1st service have changed the oil - which was missed - but even if the warranty was valid, it won't cover running out of oil because the level hasn't been checked...

  • fair enough thanks for the advice
    the moped was bought for about £1300, I'm looking to go for my full license soon(currently have CBT) and once I have that will likely get a bigger bike so not much point to getting this 1 repaired
    costly lesson regarding getting the bike serviced :/

    Well I suppose it is if you are throwing the 'bike away, as opposed to selling it for £500 or so as a runner, but the service would have cost £150 at least, so with a £350 bill you are only £200 down.

    I want to go back to The Olden Days, when every single thing that I can think of was better.....

    (except air quality and Medical Science ;))

    Lobbing it in the bin may be overkill...

    I very much doubt it's depreciated so rapidly that a £350 repair on a £1,300 new ~1yo, 1k mile bike is more than the current value.

    Let's say it's depreciated like a stone, so in good order would only be worth half the original £1,300 - so £650. That's still putting you £300 up by repairing it then flogging it, rather than binning it.

    You could also look on ebay for a replacement engine, could be a few hundred quid
