Attending a court hearing

i should have attended Court way back in March regarding a parking fine but due to Covid 19 the date was put back.  All relevant paperwork sent to Court.  This matter has been ongoing since March 2019.  I have now received. N24 General form of Judgment stating due to Covid 19, the Court is operating with a limited number of court rooms and if both parties agree the court will deal with the claim without a hearing and the District Judge will determine the case.  I feel I should not agree to this request and  ask for an attended hearing.   The Claimant (HX Car Park Management) has previously stated he will not attend court but his Solicitors (Gladstones)  I presume,  will.  Any advice will be much appreciated.  Than you. .

    Read the Telephone hearings thread by coupon mad posted many weeks ago , focusing on the issues you have raised , because you are not the first victim of the court and pandemic issues and won't be the last either

    You presume wrong , Gladstone's solicitors never turn up at hearings

    Some Nightingale courts may take on some of the work , but even then video or telephone hearings are the courts preferred methods in these covid times , not face to face hearings

    It will only be determined by the Judge on the papers if both sides agree (not recommended).

    But it's unlikely you will get a face to face hearing, these cases are being conducted remotely by telephone, or by video using CVP or Skype.

    Gladstones won't be involved, but will delegate to a freelance agent to argue the Claimant's case.

I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx.     Nine times out of ten these tickets are scams, so consider complaining to your MP., it can cause the scammer extra costs and work, and in some cases, cancellation.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, and an independent appeals service will be set up,


    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
