Pnc charge

Hi, 
I received two pnc from a carp park, 4 months after the date on the pnc, the pay machine was constantly out of order, I have photos of that, i appealed and they ignored the machine being out of order and it taking 4 months, I've emailed them back and emailed the POPLA, service to appeal it there but haven't heard back from either, I've had a Google and it seems they only have 28 days to issue the pnc, can any one comfirm this please ive tried to find the actual law on it so I can quote it back to them but I'm struggling to find it, any help greatly appreciated as it's been passed to a debt recovery firm now

    Hopefully it was a PCN you received.  Were you going fishing?  Read the NEWBIE sticky on the first page of the forum for all advice you need for dealing with a PCN.

    Nine times out of ten these tickets are scams, so consider complaining to your MP., it can cause the scammer extra costs, and in some cases, cancellation. 

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up later this year,

    Just as the clampers were finally closed down, so hopefully will many of these companies, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    They have 6 months to issue a PCN , not a law , it's their Kadoe contract to allow them access to the DVLA database records , so they can definitely issue it 4 months later

    A driver has liability for up to 6 years in England and Wales , 5 in Scotland , for any court case

    Popla do not accept emailed appeals , you upload them to their Portal and they adjudicate

    Was the driver revealed in any communications or appeals ? If yes then they may be liable for up to 6 years

    Debt collectors are powerless

    Which parking company issued the PCN,s ?

    The company is smart parking, I was the driver, I did park there, problem was the machine was out of order in occasions, one time I was something like 18 mins over and the other time I bought one ticket and then the machine was bust so couldn't get another ticket.

    Also my reg was meant to added to list for free parking but it was never passed over.

    you dont have to say who was driving, and should not say, UNLESS you have told SMART or popla who was driving

    the golden rule is never reveal who was driving

    You'll know from every other Smart Parking appeal thread (and the NEWBIES thread that names Smart Parking specifically as one that doesn't use the POFA) NEVER to say who was driving and then the keeper appellant wins at POPLA.

    Dead easy!

    Read what Pete Wishart MP said recently in the House of commons about Smart Parking.


    "I am sick and tired of receiving emails from people complaining about the behaviour of parking companies, telling me that they will never again visit Perth city centre because of the negative experience they had when they had the misfortune to end up in a car park operated by one of these companies. I have received more complaints about one car park in the city of Perth than about any other issue. That car park is operated by the lone ranger of the parking cowboys: the hated and appalling Smart Parking—I see that many other Members are unfortunate enough to have Smart Parking operating in their constituencies. It has reached the stage where one member of my staff now spends a good part of each day just helping my constituents and visitors to my constituency to navigate the appeals process.

    The BPA does not have the ability to regulate these companies and has shown no sign whatsoever that it is trying to get on top of some of the sharper practices. The BPA gives a veneer of legitimacy to some of the more outlandish rogue operators by including them in their membership, allowing them to continue to operate. The Bill will oblige operators such as Smart Parking to amend their practices.
