Devere - ticket for parking in own space

The freehold is owned by Fairhatch GR Ltd. There is a management company and a separate managing agent .The managing agent said to take it up with Devere. I believe I was incorrect above in saying I'd approached the management company, it was in the fact the agents.NeilCr said:
Who owns the freehold of the development?ossie48 said:Its simply a residents association who meet every month to discuss trivial things. Its quite a big complex with a fair few retired folk . I had a quick chat with the secretary to sound them out. They said residents who previously fell foul of Devere and permits had no luck and usually ended up paying them.
They employ the MA and are, probably, the signatory to the contract with DeVere. An approach to them may be the way to go next.0 -
Whatever the "regulations" are, breach of them would be (indirectly) breach of the lease. The remedy for that is not to pay a third party stranger to the lease agreement between freeholder and leaseholder an arbitrary sum of money. The regulations may be to display a permit. That doesn't mean Devere are able (through their signage) to offer you a contract to park in your parking space, as your lease already grants you that right.ossie48 said:I have the lease. The only parts that relate to the parking space are as follows.
2. It states . To comply with and make all reasonable endeavours to ensure that all persons living in or visiting the demised premises or using the parking space shall comply with any managers regulations which may be in force from time to time.
So nothing directly in the lease about displaying a parking permit, however point 2 above about complying with managers regulations. We are trying to find these 'regulations' .7 -
Hi well a sad end to this. The family member concerned is a key worker in an extremely stressful job who just doesn't need the hassle and was actually going to pay the £60 to make it go away until I Intervened. Instead she appealed and pointed out there was nothing in the lease about parking or permits etc etc.Coupon-mad said:I would appeal to Devere as it looks better later when she wins in court.
They came back with the £30 admin offer as full and final settlement which I think is daylight robbery. I was up for the fight but they weren't and they split the £30 between the pair of them (shared flat) to make it go away. They paid it before I even saw the reply.
As I said I was up for the fight but it wasn't my car, my ticket, my flat, my parking space and there comes a time when your loved ones have to fly the nest and make their own way in the world. They don't listen to you when they're kids and likewise when adults - their loss .
I guess you could argue parking enforcement is an absolute necessity for residents due to the location but l know damned well the so called 'warden' entered a locked underground parking facility that only residents have access to, more than likely with a view to targeting residents and just being a jobsworth.
Thanks for the help and advice.
