PCN issued in resident parking.

Options
I have valid resident parking & parked my car legally on 09/07/2020. When I returned to my car on 13/07/2020 I discovered I’d been issued with a PCN and the parking bay had been suspended after I had legally parked. I appealed the PCN on the grounds that there was no notice of intention to suspend parking & have been told that my appeal has been denied & I should visit my car daily to check that parking bays have not been suspended after I have legally parked.
I think that this is unreasonable, the council who issue resident parking permits have my contact details, can I appeal again.

Yes - as long as you are the keeper and this is not a leased or company car - of course you can.  The reply tells you that. There will be an NTO stage.  Don't ask what that is, the PCN says so and probably the rejection letter does too.

Post about your PCN on pepipoo for more advice as we mainly deal with non-Council scam PCNs:

Check out a few posts on Pepipoo to get the idea of what type of information that people post; do not use a Hotmail address for registration  the site does not like them.

AND NO POSTING WITHOUT PICS OF BOTH SIDES OF THE PCN...YES, THE BACK AS WELL.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

What does your lease/AST say about parking? Does it mention the need to display a permit? then it may take primacy over the self serving TnC of the scammer, and interfere with your lawful right to “quiet enjoyment” of your property, possible an offence under The Landlord and Tenants Acts.

Nine times out of ten these tickets are scams, so consider complaining to your MP., it can cause the scammer extra costs and work, and in some cases, cancellation.

Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, and an independent appeals service will be set up,

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

You never know how far you can go until you go too far.

This appears to be a "council" ticket as opposed to a private parking ticket
The confusion takes place as private companys issue Parking Charge Notices, sometimes also called Parking Contravention Notice, or even Payment Charge Notice - all abbreviated to PCN  which is a trange co-incidence as real parking tickets issued by real authorities are also called PCN's this time meaning Penalty Charge Notices
the waters are further muddied by council employing private contractors to enforce pakring, and some private companies operating under the beleif that they can issue penalties in some by-law controlled land such as railway stations

Almost any newbie with a single figure post count gets a nine times out of ten, regardless of context! 🙄😎
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
