Still haven't had a refund for a May holiday, the promised date has passed and I'm losing patience.
I have travel insurance, I paid the deposit of my holiday on credit card and the holiday was an ATOL package holiday with an ATOL certificate
1. Wait a bit longer (why) 
2. County Court Money Claim (small claims)
3. CAA complaint
4. Credit Card Section 75 (might not be possible - see below)
5. Debit Card Charge Back (is there a time limit? Based on pay date or when service should be delivered?)
6. Travel Insurance

We booked a cruise and stay holiday, setting off on 25th May, for our 30th anniversary, booking in August 2019 through Thomas Cook retail and I paid the deposit on credit card.
Obviously Thomas Cook went bust but the name on the ATOL certificate was Travel2.  They told me they were responsible for the booking and emails have come from both Travel2 and Stella Travel who are both part of the dnata group, owned by Emirates.
I paid the balance by debit card in February to dnata as instructed and received confirmation from Travel2.
Jet 2 cancelled the flights in early April and the cruise was cancelled in the middle of April, we didn't hear from Travel2 so I emailed them asking what was happening, no reply was received.
At the end of April we were emailed by Travel2 and asked if we wanted cruise credit or a refund and I replied asking for a refund.
A few days after our travel date I sent an email asking about the status of our refund and was told I had to email another address to ask for a refund which I did.
I received a stock reply with a timetable based on departure date  that gave me a refund date of this week, although this is far in excess of the 14 days I thought I'd let that go given the problems everyone is having.  However there is still no refund and no other contact, and I feel we have just been put off.
If I try to make a section 75 claim does the transfer of the contract from Thomas Cook to Travel2 invalidate it?
Given the debit card payment was back in February, is a charge back still viable?
Which of the above is likely to be quickest, successful, easiest?

    Probably adding to the delay and your situation is the news that all the Travel2 staff in Glasgow have been told that the office is to close and staff to be made redundant.  A few might continue working from home. The main operation of Travel 2 is to be consolidated and moved to another office in England.

    Whilst legally a refund should be given in 14 days this simply has not been practical or happening with most travel firms. I suspect you will need to show continued patience.

    I've lost my patience with this.  I've decided I'm going to use the Money Claim service.  The lack of any further response or even a progress report is not on.  I feel sorry for the staff involved but the ultimate owner of the group is Emirates and they are short of a few pence.
    What will I need before I start?  Does anyone have any advice or experience of claiming in this situation where the original contract was with Thomas Cooke?  I'm pretty sure the ATOL certificate in Travel2's name means they are on the hook for a package holiday refund.
  • We had a hotel booked with Travelbag, owned also by dnata, had to pester them but got the refund eventually once the travel date had passed. 
    Had a load of hassle with Virgin Atlantic, went down the section 75 route, forwarded emails from Virgin saying I was entitled to a refund, money back in my account in 3 days (Virgin 150 days plus currently, if ever)
    Try that first.

    I did think about section 75 but the implicit switch in contract between Thomas Cook and Travel2 could be problematic.  Then if I clam the deposit on section 75 and a chargeback on the balance, what happens if only one of those fails.  With moneyclaim I'd claim it all in one go from Travel2.

    I do know that Travel 2 are now refunding, they had to wait for funds from Dubai as many suppliers such as our friends at Virgin Atlantic and many hotels did not refund as they should. It is up to you to decide whether you want to go down the MCOL route but I would be tempted to wait another 14 days to see if the funds are refunded back onto your card( that assumes T2 actually have your card details which might not be the case if you paid TC!)

    Travel2 have my card as I paid the balance to them.  I know Jet2 refunded the cancelled flights quite early as did Celebrity Cruises.  Members here keep suggesting waiting but I have only had one reply, I haven't had a personal reply since I paid back in February.  The law says 2 weeks, they have missed the only deadline they gave me.  I've already waited then waited again; waiting benefits them and not me as I imagine a big company like Emirates is happy investing interest free cash they are borrowing from me and other holidaymakers. In practice they probably have the rest of the week until I get organised to make my claim which will happen next weekend.
