Private medical treatment re-payments

I was involved in a car accident three years ago and went with the law firm recommended by my private medical insurance company use. The case is due to be completed & I have had an offer of  compensation but the law firm say I must now pay for the cost of the medical treatment of £21.000 incurred by the insurance company.

Is this right as I reckon I have paid them almost £17,000 in monthly payments over the years for medical cover. Is that not why I pay for medical insurance cover so it won't cost me a fortune if I am involved in a car accident that was not my fault.. Any advice please

You need to speak to your solicitors.

If medical treatment needs repaying then it should be included in your claim against the third party. It could well be that it is already is and you've just not realised/considered this - you need a breakdown of your claim against the Third Party by "head of claim" (ie area or type). This should show Pain, Suffering and Loss of Amenities (the money purely for the injury itself), any loss of earnings, medical treatment etc all as seperate numbers. What the third party is offering may be a "global offer" which is a single number that doesnt break down to the individual components

You may also need to consider your funding arrangement with the solicitors; if it is "no win no fee" then they may well be taking part of your award in which case if you get the full damages including £21,000 towards treatment they will take a slice and you'll need to backfill from the rest. This is perfectly legitimiate/normal however varies greatly between firms.
