Hello my name is Jan my company or client for my agency closed on 24/03/2020 as I was working there from 17/02/2020(officialy) but I worked all year before there however when come to lockdown Agency told me that im not going to receive furlough as im only on temporary contract/assaigment contract so I let it be, later today I was calling with Site manager of my agency to explain me why I didnt get furlough when my contract was included and she replied to me that when client closed due lockdown I didnt had guarantee work with them when they decide to reopen + I was on assaigment contract so I could find another job and never come back I tells her that i was texting every week that im working for 2 yrs on same place and i was texting every week during 6 weeks kf lockdown that im available to work, she said that client didnt confirmed me on their list to come back to work after lockdown thats why I didnt received furlough that they cant give it to everyone, so I asked her how is than possible that I was back at work sooner than people whose was on the "list" and furloughted she couldnt answer me that and she asked me to come to her office tommorow to sort it, what can I do im I in right to receive furlough for 6 weeks back? Thank you for answer

The answer is not going to be one you like, you’re not entitled to furlough, nobody was it was down to the employer. If you hadn’t agreed to furlough and the agency hadn’t previously claimed for you they can’t claim anything at this point. I wouldn’t be very optimistic a meeting is going to lead to the result you want.Have a quick search on here and you’ll see many other people in a similar situation to yourself, many agencies chose not to use the furlough scheme, nobody could force them to.0

So basicaly they choosed their "own" people to be furloghted nice than...0

Furlough was entirely optional, firms could choose to use it for some, all or none of their workforce. Many agency’s didn’t use it at all. It is however far to late to query it now, CJRS is closed to new people, the ship has sailed.0

I only wanted to know if I was in right to received it and if I have been asking for it they replied I was on temporary contract so no furlough for me that was the answer so my question is If i had right to received it and If I can push agency to pay me money they should ask for goverment before, because I know few people thaz agencys done same to them and they been forcing agency to do something they received money from agency for 6 weeks of furlough as they never received their p45 or p60 because agencys said to them they dismissed them as their client no offering job for them0

No, you didn't have any rights to be furloughed. It's now too late anyway because the last date that you could have been furloughed was 10th June.

Some people were eligible to be furloughed but no one was 'entitled' as it was always entirely the employers decision. However, as has been said, no employer can put an employee on the furlough for the first time now anyway as the scheme has closed to new people. It's not difficult!
