MYPPIREFUND - Not Happy with current situation
Comments
-
Anyway, as you can guess, some time passed and I did receive a letter from a lender stating that I was entitled to some PPI refund, I didn't sign any letter of authority so how can this be?
The FCA instructed banks to turn enquiries into automatic complaints in the lead up to the deadline. So, that is how it can be.
The FOS state that they are impartial but it seems to me that even though myppirefund cannot provide any hard evidence the FOS has taken everything that myppirefund has said at face value and gone with thatThe FOS are an independent arbiter of complaints. However, in scenarios with missing information and allegations that lack evidence, it is very difficult for them.
The bottom line is that you asked them to do a check. You didnt bother putting your own complaint in. However, the check resulted in a payout. So, you are in the money because of the CMC. Had you put your own complaint in, you could have used that as evidence but as it stands, it just looks like you are trying to get out of paying the CMC. I am not saying you are. That is just how it looks.

Nonsense, I put my own complaint in and waited 8 weeks for the result. Wasn't happy with outcome and got FOS involved and for information I wasn't trying to get out of paying CMC as that was paid, I was just not happy at the way the CMC used misleading information to rope me in. You cannot sign someone up for a service that they didn't agree with and your statement about the banks and automatic complaints is as bad as it sounds as it means that there is no longer a "free no obligation check"

Nonsense,
No it is not nonsense.
You cannot sign someone up for a service that they didn't agree with and your statement about the banks and automatic complaints is as bad as it sounds as it means that there is no longer a "free no obligation check"In the lead up to the deadline, there wasn't really a checking service because of the way they were automatically turned into complaints. However, the key is the contract you signed. Some do say that their charge becomes applicable if the enquiry automatically results in redress or they require you to tell them that you do not wish to proceed.
None of us here are fans of CMCs. The proper regulation of them was long overdue and even now they are still on light regulation compared to other financial services firms. However, they are pretty good at getting their contracts worded to ensure they get paid for doing very little.
