NCP appeals. Fined for over waiting.

I have read so much and I'm even more confused! I have received two parking fines from NCP on the 28th April 2020. One was for a parking period 23.45pm until 00.16am on the 16/01/2020.  I have tried to appeal the first, but it was rejected, It also gets more confusing as I have appealed the wrong PCN with the wrong defence . The other  is a double dip saying that the car entered the car park on the 23 Jan and left on the 27th Jan. I was not the driver but am the owner. I am a teacher and used the car for work on the days that NCP say the car was parked. I have ignored this notice as its ridiculous and cant believe this is allowed, but this is the PCN I thought I was appealing so have confused the appeals? Am I going to have to pay as both fines seem are unfair. Although the first says the car  was waiting for 30 mins and only a 20 min wait time for pick up allowed, is this still the case when the trains are late? Does this come under the grace period allowed, I have read a thread regarding new legislation but am over that by one min and does the driving in and out give me that time? Would really appreciate the help as my job hours cut and my financial situation is hard right now.

    Have you read the newbies thread? Yes or No. Im guessing no because these are NOT FINES :)
    16.01 - any payment? What was the reason? So it was received 3 months later - april? Did you ID the driver? What appeal did you send? 
    For the double dip - of course you dont bloody pay. Noone pays NCP. Theyre so easy to beat. 
    Jsut tell them the vehicle was not parked for 4 days, it was in use, and cancel the charge as their systems have had an error. You require them to erase your data, as they never acquired any reasonable cause to access your data.

    If you have had a rejection letter then you are at POPLA stage - and you'll win, if you were not the driver and didn't tick 'driver' in the NCP appeals drop-down menu when first appealing. This is the same as all NCP POPLA appeals. 

    If this was at a train station (WAS IT?) try searching the forum for NCP POPLA railway and reading every result till you find a good (recent) one to copy and adapt.

    Nine times out of ten these tickets are scams, so consider complaining to your MP., it can cause the scammer extra costs, and in some cases, cancellation. 

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up later this year,

    Just as the clampers were finally closed down, so hopefully will many of these companies, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    For the double dip you tell NCP that their systems are defective and you are issuing them with a data rectification notice under GDPR.
    Plus they no longer have any just cause to hold and process your personal data in regards to pursuing a parking charge notice
    From the Plain Language Commission:

    "The BPA has surely become one of the most socially dangerous organisations in the UK"
  • Thank you all for your help.  I have read all the newbie information but some is covered and I have had trouble piecing some sentences together. From the two notices I am not concerned with the double dip as if it goes to court I can get evidence that the car was not parked for the period. I am concerned about the other which was for over waiting for a train. The car entered and left the train station  30 mins apart and the waiting time is 20 mins, a ticket hadn't been bought. So was there a violation to waiting? Should there be a grace period and does the time entering and exiting have any bearing? The train was also late does this make a difference?

    My second issue which is my own fault is I sent an appeal regarding the double dip so evidence for that in my writing taking responsibility as the driver but used the wrong code and used the code for the waiting ticket which I wasn't the driver for! Do I write and explain this or do I contact popla with this whole story explaining what I have done?

    Sorry I know this is confusing, really appreciating your help!

    Yes.

    No.

    But this fact (below) wins at POPLA, although you mean 'registered keeper':
    I was not the driver but am the registered keeper and there can be no keeper liability on railway byelaws land and NCP has not used the POFA. owner.
     
    Presumably you appealed and got a POPLA code for them both so they are easy to win.  You can copy any other NCP railway POPLA appeal you find and you need to read post #3 and look at the POPA appeal templates and use them.  Show us your draft, assuming you have POPLA codes for both (and the NCP appeal rejection letters are not dated more than 32 days ago)?
