Maybe, but they can still lawfully cancel it just by giving you notice of at least as long as the leave you have booked. They can then instruct you to take it at another time, again just by giving notice.jessi_clarke said:I’m not taking unpaid leave? Annual leave Has to be asked for after Christmas for the next year so this was agreed at the time, I have moved weeks before as the business asked and rearranged, I have other plans these weeks as things got cancelled during lockdown and I rebooked them when I knew I had time off
My point about unpaid leave (should you ever request it) was that an employer isn't obliged to grant any apart from the emergency dependent situation I mentioned.
You need to work with them to try and find a solution as your "rights" are limited.1 -
I have been asked for a mental health letter off a doctor which I am talking to him this week about , I got asked to go back early and I agreed to go back 2 weeks earlier then they said I should be paid my holidays, as I have already had time off I feel like I agree to this they will ask for something else0

It is not uncommon with long periods of sick leave, if company sick pay has run out, to allow the employee to take some or all of their holiday so that they have more than SSP coming in. It is not however obligatory either way.jessi_clarke said:I have been asked for a mental health letter off a doctor which I am talking to him this week about , I got asked to go back early and I agreed to go back 2 weeks earlier then they said I should be paid my holidays, as I have already had time off I feel like I agree to this they will ask for something else
What can be forced however, fairly easily as I have described, is when you can and cannot take annual leave once your return from sick leave.
Obviously your health must come first. However, keep in mind that many employers would be considering their options and taking at least preliminary steps towards an occupational health assessment and possibly considering ending the employment with this length of sickness.0 -
Yeah I think this is there way of getting me to leave by moving me locations0

You have provided one, its called a fit note. Beyond this, this isn't what a GP is for and you will likely incur a charge for further information.jessi_clarke said:I have been asked for a mental health letter off a doctor which I am talking to him this week about
Inform your employer this is what occupational health is for, not your GP.0 -
They aren’t bothered if I can’t provide a note they’ve said they can’t help me as everything he put in writing it m my sick note they are going out of there way to not do so far0

What do you actually expect an employer to do in this situation? They are struggling to keep their business going and having to deal with someone going off sick for months because she can't get childcare isn't going to be high on their list of priorities.jessi_clarke said:They aren’t bothered if I can’t provide a note they’ve said they can’t help me as everything he put in writing it m my sick note they are going out of there way to not do so far0 -
No I had a breakdown not because of childcare that was in addition to a number of problems0

Clearly things aren't easy for you, but your employer seems to have been pretty patient. As someone else has asked, what do you expect them to do, given the problems they are having?jessi_clarke said:No I had a breakdown not because of childcare that was in addition to a number of problems0 -
To be blunt you either follow their requests or you risk losing your job, at the end of the day that is up to you.0
