BW Legal/PRAC help needed please

I had a payday loan from PayDay UK in August 2016 for £350. I never heard from them or paid them until July 2017 when they finally sent a statement for £930.00. After taking advice from Stepchange for my debt problems I wrote to Payday to make an unaffordable lending claim. I received no response. In January 2018 they wrote, along with PRAC to advise the debt had been assigned to PRAC. I wrote to both parties to advise again of my unaffordable lending complaint. I received no reply and in June 2018 I received a notice of court action from BW Legal. I wrote to them to advise of my complaint for unaffordable lending and again heard nothing back until August 2019 when they sent another letter advising of court action. I again sent back my defence and copies of all the letters I have sent to all parties. I am now stuck in a cycle of court threats and defending them with BW Legal. My biggest concern is that PayDay UK closed my account on my credit file but PRAC opened a new one and instead of it showing as defaulted it shows I miss my payments monthly for the past year. I have worked hard to turn my financial status round and this is having a very bad effect in my credit file. Please can someone advise how to fix this mess

    Very unusual to wait a year without taking your payment, infact i`ve never heard that before, usually they take payment via your debt card, a statement means nothing, you were still responcible for paying the debt, usually on your next payday, why would you wait for a statement, and for a whole year, can you clarify that bit anymore please ?

    Making an affordability complaint is your statutory right, and whilst a dispute exists, collection activity should be suspended, Payday UK have since stopped lending, and are subject to an arrangement with their creditors, there were many, many complaints, its easy to chase yours up using the contact details below -

    PRAC will have bought your debt, you should write and inform them of your ongoing complaint.

    Was your account with Payday UK defaulted originally ?

    If so, send a SAR to obtain that info from them, once recieved, send a copy to PRAC and tell them to restore your file to how it should be within 28 days or you will escalate to the ICO.

    If it did not default, then it is being correctly noted, that your payments are still in arrears, and until this complaint is resolved, it may be wise to agree some kind of repayment plan with them.
