Whats Our chances?

Options
Me & my wife visited McDonald's & parked in the pub car park next door like we always have (We visit the pub now & then For food before Corona, we won’t be anymore!) We we’re only there for 15 minutes & my wife got out to put the rubbish in the bin, They have recently fitted ANPR (we didn't notice At the time) we then received a PCN, we went  back to see & they do have signs Up, they also have a photo of my wife leaving the car going to the bin

Please see all the attached photos

Have we any chance of getting off this PCN?

Thanks.

If you have read the NEWBIE sticky, you will know that plan A is always to complain to the landowner.  If that won't work because they are closed, then you need to send the appeal written in the NEWBIE sticky first post in blue text to the PPC with no additions, deletions or alterations.  If you have not read the NEWBIE sticky - why not?

Not based on the above account or signage , but only a judge can decide as it all depends on various legal arguments

Ukps have 6 years to try a court claim

The reason landowners do this enforcement is to stop this kind of behaviour , so I presume that the pub has an iPad on reception or at the bar that you input the VRM to exempt the vehicle and to authorise it's parking on the pub car park ?

I have been to many similar pubs in the last 12 months with similar schemes , it's becoming standardised for this industry to stop fly parking

  • Yes we have read all of the different bits, still a bit confused if we have a case or not because of the signage & case my wife left the car for 30 seconds.

The plan is to complain to the pub, as it is a place we used before The Corona Virus stopped us all going out, this ANPR is new as we never had issues before or were asked for our number plate when visiting the pub.

we will also appeal on there sight using the letter supplied on the 21st so dealing it .

The timings on the two photos on the NtK are a bit blurry, but do they say 'Arrival 18:47' and 'Departure 18:47'?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

It's the unauthorised 15 minutes on site that matters , not the 30 seconds she was out of the vehicle

The keeper recipient appeals as keeper using the blue text template from the newbies FAQ sticky thread near the top of the forum , unchanged , to ukps , this will be rejected by ukps

Every time a driver parks a vehicle , it's their legal responsibility to check signage and ensure that the vehicle has permission to park , so make sure it's done in future

and if its a national chain complained (sic) to the CEO at head office

Why should he/she be concerned, OP was using the car park to dine elsewhere.

This PCN is hilarious.  Your car is shown having done a U turn - and is facing the other way - within one minute.

I'd appeal and take this to IAS (NOT SAYING HOW LONG YOU WERE THERE OR WHAT HAPPENED - OBVIOUSLY).  Then take your evidence of the ''1 minute PCN'' to the IAS I don't think UKPS will want to show the IAS that!  Either it's a predatory PCN or it's evidence that they have manipulated the time of the second image and typed it in with whatever they fancy.

What timing is shown within the black band under the second image?

You do know not to pay this - you have read the NEWBIES thread & know how to appeal as keeper, yes?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
