Thanks for all supportive comments, Ebay have actually refunded, despite myhermes being at fault. As one forum user above points out, they have breached the law really by disposing of the item regardless of its state and ought to be held accountable though. I will never accept that is acceptable practice
How can they be breaching the law when you agreed in the T’s and C’s that you gave them permission to do this?

The alternative could be a letter saying “Dear Flarris, here is your prohibited item we re-packaged for you.... along with a claim for £10,000 in damages to cover the contact dermatitis our employee suffered by handling a prohibited item from which a small amount of remaining fuel had leaked and which you explicitly agreed in our terms you would not send through our network.

I’m playing devils advocate, but I would count yourself lucky that you have suffered no loss in this instance. I also speak from experience as I once “lost” a £45 tin of Farrow and Ball paint which leaked in transit and also wasn’t covered. Fortunately it was contained within the outer packaging, but had it leaked all over 50 meters of their conveyor system, Van, or someone else’s parcels, who knows what course of action they may have pursued against me!
    • The rich buy assets.
    • The poor only have expenses.
    • The middle class buy liabilities they think are assets.

Oh dont. So many leaking paints/oils etc.
The damage to parcels alone can be biblical

I once had a DPD driver turn up and realise a pallet of washing up liquid had leaked. It was all over too, everything on the deck was ruined. Fortunately it never affected my delivery.
