Write Off Payout

Good Evening,
                        I had lent a family member a car And added them to my multi car policy in their name but I’m still admin for that policy and responsible for all financials.whilst they were driving it they was hit and the car was written off. We agreed a settlement, now the family member has diverted the payout to their bank account and done a bunk Abroad with the money . Is there anything I can do or is it tough luck for trusting this person. Any advice other than don’t lend cars out very much appreciated.

    I presume insurance paid out to your family member as the policy was in their name after checking there was no loans/credit attached to the vehicle. was there any loans/credit attached to the vehicle?

    although v5 only shows who the registered keeper of the vehicle is, it may be a ground for complaint if they paid out to a different person?

    How did the insurance company establish who the owner of the vehicle was?

    have you spoken with the insurance company at all?

    I would start noting down the dates and incidents in a piece of paper so you have all the records...



  • There was finance outstanding in my name which was paid off before payout. I have spoken to the insurance company but not since the payout had been processed.

    If it's Admiral they used to / may still have an allowance for named drivers to discuss the policy with them.
    If there has been any deception from the additional driver and Admiral's procedures are not robust enough then they will ultimately be liable to still pay you.
    There are not enough details to give full advice, you need to give us more information
    If it is Admiral, there is a poster on the Piston Heads forum whose user name begins with Z who works in their fraud department. A full descriptive post on there may elicit a response from him (He is unbiased when commenting on Admiral) and will have better knowledge of their anti fraud systems (Although he generally is looking at fraudulent claims eg thefts but will have knowledge of their systems for this

    I would wonder whether the family member had an insurable interest in the car. This looks like a right old can of worms.
