    I had no idea about this, again this was never mentioned to us by the solicitors. I wish it had been as we all knew she would die due to her accident but she survived for 25 months after it happened and a will would have prevented all the difficulties we’re having now. It was something we asked them about time and time again, as well as what would happen when we lost our mum if it wasn’t settled. They kept telling us it would be okay we just needed to be executors. Thank you for this information though, I know a lot of people who work with or have learning disabilities and this could be helpful to them.

    Thank you (getmore4less) I will look into those. I’m really not sure whether they have, the original solicitors are very hard to get hold of and I really feel they just want to wipe their hands of the case. The second solicitors haven’t been instructed just simply asked for their opinion and I’m not sure how much solicitors are willing to do without being instructed. Thank you again

    What surprises me is only your mum took out the LOA grant for your sisters estate given the complications(additional to your particular problem) that can happen when a sole administrator can no longer act.
    There was no reason for you or others  to have been included.

    Again we were told she was the only person able to apply other than my sisters dad. Unfortunately we have no knowledge of law and followed the solicitors advice trusting it would be okay. It was no secret to them that my sister and my mum both had a terminal diagnoses. Throughout we raised our concerns regarding the claim and their deaths and they continued to say we should be able to continue if mum named us as executors which she did. It’s only been since her death that they have said we can’t. They are complaining they have already done work that they likely won’t be paid for and went above and beyond and therefore are not willing to do anything now without all costs ring paid up front. They have simple told us to find her father or give up
