I called my cc to just give an overview and they said I would be entitled to my money back from what I said - paying for something and not receiving it.I told them I'll see how the shippers insurance claim goes first.My questions are, if I go down the cc route :- given I paid the auction house who didn't lose the item, and the shipper separately, will the claim the cost of the item from the auction house as that seems unfair on them?- as I insured the item 85-90% of the value, would that affect the cc claim, and if not, I guess the cc will just pay back the insured value like the shipper?0

The CC refund under a section 75 claim would be what you paid ... if an insurance claim only recovers a partial amount then I think you can reclaim the balance under S75.1

Where the CC claims it from is not your concern ... that's their prerogative whether (and wherefrom) they wish to seek to reclaim whatever they've paid out under your S75 claim.1

Item was supposed to arrive 3rd July.
When I initially spoke to a young sounding guy at Nationwide, he said there is no time limit. This website says 45 or 120 days?
This Monday, I'm going to follow up with the shippers to see how they're insurance claim is going. It will have been 3 weeks, but they said it can take 4 to 6 wks. I'm thinking to initiate a credit card claim if no progress at the 3 wk mark.
Would this be wise or just wait out up to 6 wks.0 -
The time limit applies to chargebacks .. I thought you were going to be doing a Section 75 claim?0

Well I'm not sure what type of claim I need to make. Nationwide just said go to credit cards online, go to disputes and fill out the form.
Anyway, I'm checking whether to do this now or wait to see the outcome of their claim?
Because as I insured to around 85-90% of paid value, I will later be doing a credit card claim to try and get the rest back later anyway.
But I don't want to jeopardise or overlap their claim first.
So how long do I give them is what I want to know, it's around 3 wks. Shall I wait til 6?0 -
The cc agent was wrong in assuming it was a simple not received purchase, you via your agents did receive the purchase so a claim against the auction house is a no go. Your claim is, assuming the cost of the shippers service is in excess of £100, a s75 for the cost of their service and consequential losses. A chargeback is of no use as that will only be against the actual payment to the shipper and will not include the cost of the missing item.
