DCB LEGAL LTD CLAIM FORM

Hi,
 
In March last year I received a parking fine for £60  from bank park management. I found out I had paid to park but entered my registration wrong. I emailed bank park management who offered to reduce the fee to £15, I responded disputing any fee at all.

a few months passed without hearing anything and then ZZPS sent me a letter with an increased charge of £100 for failure to pay. I emailed ZZPS explaining I hadn’t agreed to the reduced charge and was still disputing it. I got nothing back and chose to ignore more letters I received from ZZPS looking at what people had said online and received a couple more letters threatening CCJ’s if I didn’t pay.

At this point I emailed my local MP and asked for help as I just wanted the issue resolved. They couldn’t really help.

it then went months and months without hearing anything, I thought it had just gone away. Until yesterday when I received a claim form from DCB legal stating the below;

1. the defendant(D) is indebted to the claimant (C) for parking charge(s) issued to vehicle XXXX XXX at Xxxx.2. The PCN details are 02/03/2019,206891.3.The PCN was issued on private land owned or managed by C. The vehicle was parked in breach of the terms on Cs signs (the contract), this incurring the PCN.4.the driver agreed to pay within 28 days but did not. D is liable as the driver or keeper. Despite requests, the PCN 8/ outstanding. The contract entities C to damages.
AND THE CLAIMANT CLAIMS
1. £160 being the total of the PCN and damages. 2. Interest at a rate of 8% per annum pursuant to s.69 of the county courts act 1984 from the date hereof at a daily rate of £0.04 until judgement or sooner payment. 3. Costs and court fees.

any help with this would be great. I just took advice over this whole process and feel I’ve screwed myself here!

i only have 14 days to reply to if people could help ASAP it really really would mean the world.

    Hi, I was in the same predicament as you - paid parking but made mistake with registration, did exactly the same as you and have been rewarded with a Court Claim in the post today.  I am defending it all the way.  These firms are just out to get what they can and need to be stopped.

    read this thread and do exactly the same as we told them to do if you have a court claim from the CCBC in Northampton ? if yes, what is the issue date on the CCBC claim form ?


    or do you have an LBC with 30 days notice ?

    or do you have a debt collector letter ?

    I know I’m so frustrated with it! Trying to charge me £252 now!

    Hi Redx,

    thanks for getting back do quick, it’s not a LBC or a sect collector letter it’s a ‘Claim form’ and yes it’s from CCBC in Northampton, issue date is 8th July?

    then follow the same advice as in that link I gave you, seems to be a lot issued on the same date by Bank

    With a Claim Issue Date of 8th July, you have until Monday 27th July to file an Acknowledgment of Service. If possible, do not file an AoS before 13th July, but otherwise, there is nothing to be gained by delaying it. 
    To file an AoS, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.

    Having filed an AoS, you have until 4pm on Monday 10th August 2020 to file your Defence.
    That's over four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
    To create a Defence, and then file a Defence, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service instructions.
    Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

    Thanks so much for your help with this - i'm really quite naive with these sorts of things.

    Please can someone have a look over the below and let me know what they think?

    Also i could do with help on bullet point 18 - i know this is pretty much the only part i needed to do myself but i want to ensure my paragraph doesn't stand out as being less intellectual and sophisticated!

    If the particulars of claim relate to the fact that the VRM was wrong, you need to state that the PDT read your input incorrectly due to sticky keys or illegible markings on the keys.  We cannot write it for you, you are the one who was there and know why should not have received the PCN in the first place.
