Business Continuity Insurance

Like many others, Business Insurance has refused claim, as no proof that any Covid cases in business. ( infectious disease clause). As business was closed due to government enforcement AND there wasnt actually any testing/track & trace in place at that time, this seems to me like they are just wiggling out of their responsibilities.
Has anyone successfully appealed a similar decision? Or has anyone had a claim successfully agreed?
Has this issue been raised with MP/Ombudsman?

The FCA is taking a test case to the courts (started 9th June, planned to be finished by the end of JUly)

Insurance company have said this test case wont apply, but havent given reason.
Just going to appeal anyway.
