Offered new role in company or redundancy, advice needed

My company are restructuring and also want to make at least 6 redundancy. We all had the option to apply for any position in the company. I initially showed my interest and applied for a part time position while expressing at the time  that as the role currently stood it wasn't suitable for me. I was under the impression there would be an interview and I would possibly be able to negotiate my hours and salary. There wasn't an interview but I was just offered the position anyway.  I have been in the company for 21 years and decided not to accept the new position as it would leave me in a difficult financial position as they wanted me to go from full time to part time and also reduce my hourly rate of pay, I also had a flexible Rota in my previous contract for childcare. Can I decline the job offer  because of salary and hours or could they refuse my reasons and not pay me redundancy.

    You knew it was part-time when you applied but did you also know the reduction in the hourly rate?

    When you applied how did you express that it wasn't actually suitable though you were applying?  When you say the hours and pay weren't suitable?  What about the job was suitable - was it commensurate with your skills and experience?

    How easy will it be for you to get another job, especially as others may become redundant?
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

    They could in theory argue that as you applied for the job then it was suitable for you.

    Never apply for jobs that you are not 100% happy are suitable you give up your rights to redundancy and trials. 

    Before you are on notice it is just the same as asking for that new job and there can be an implied acceptance.
     
    What did you say when applying?
    That could  be critical in regecting it now if the company wants to take the line you accepted it was suitable and you have to take it to ET.

    No need to provide an explanation as to why you declined the offer made. Perhaps you were offered the job as no one else applied. When making redundancies company's are required to find alternative employment if at all possible.

    When applying by email, i said i wanted to show interest and apply for a part time position but i felt as the role currently stood it was unsuitable because my hourly rate was reducing   and that i needed more  flexible hours for childcare.  The reason why i did this is because i have been in the company for 21 years and in my previous consultation where i expressed the same concerns i was given the impression there would be an interview where i could possibly bring up these concerns. There was no interview, i was just offered the position in my consultation.

    Reiterate that the job is not a suitable alternative in its current form, you were only engaging to establish if it could be made suitable if that is not possible you will not be pursuing the job any further and will continue in your current position until that is made redundant or other potentially suitable alternative become available to consider.
