Post Vehicle sale issues
I have sold a vehicle - it’s private sale I am not a trader.
the buyer is a trader and came a couple of weeks ago to buy it, he was here for around 45mins test drive and inspection etc... and he bought the vehicle, less than 5 mins later he called to say it had an issue and came back with it.
there was indeed a minor issue and after discussion I said I wouldn’t be happy with him taking it with the issue so I gave him his money, he did say please let him know once I had the issue sorted as he still wanted to buy it.
i had someone come who fixed the problem and informed him and he said he still wanted it to buy it.
i drive the vehicle around for a few days to make sure the issue had gone and absolutely no problems.
he came back yesterday to but it, test drove again went under the bonnet and checked the vehicle over.
he was satisfied that the vehicle was fine and paid and took it.
an hour or so later he messaged me to say it had a different problem, he was still driving but the vehicle was slow.
try and cut a long story short he has driven the vehicle home and said to me that either I pay him for making it right or come and get it back and give him his money.
as a trader I believe from what he was saying he has a specialist that works for him.
my question is this, what are my obligations if any?
the vehicle absolutely did not have the problem before he took it, I drove it for several days - in fact I took it out for an hour yesterday - he test drove it and was satisfied enough to pay for it.
i must admit to being slightly concerned at this point that, after the first time he then pressured me into giving him further money off due to his wasted trip the first time and it all seems a bit convinient that this problem has only occurred once he was on his way home and my concern is they are going to come up with a big bill that he expects me to pay.
anyone have any advice on this and legally my position.
had the vehicle had any issue before he took it I would have had it fixed 100% as shown the week previous.
thanks

NONE !
You had no obligation to do anything when he called you the 1st time ( unless the car was actually un-roadworthy when you sold it)
Unfortunately you have now shown him you are something of a soft touch, and he his chancing his arm again to get more discount
Time to tell him to jog on - he's bought it , he now owns it, however many bits its in - so its all HIS issue NOT yours

Thanks for the reply
I did have a quick look online last night to try and get an idea.
i don’t think I’m a soft touch but I’m also not an !!!!!! and the first time I gave the benefit of the doubt and sorted it for him but I’m not going to just keep going.
i will happily tell him that it’s now his issue, it’s unlucky but that’s all.
as I said to him, had I have known there was an issue I wouldn’t have sold it.
thanks for your reply0 -
He's a trader, he's inspected the vehicle and was happy with it and paid the money.
You're a private seller so not expected to know as much as a mechanic or someone in the trade so your only obligation is to answer any questions truthfully however you do not have to volunteer any information.
Private sales are Caveat Emptor, buyer beware.
He has no leg to stand on, tell him to politely go away and if he feels so strongly about it the courts are there for him to use.1 -
Thanks for the reply.
i consider myself an honest person and would not have sold the vehicle had I known this was an issue - like I said I drove the vehicle for an hour yesterday before he came.
i am sorry it has happened but it’s just bad luck.
when I look back at messages from the last week he did actually ask me to guarantee giving him money if there were any problems after he took it, I didn’t do this.
but all just seems a bit convenient really0 -

Frankly, if I had received such a message then I would not have considered selling to this person on any terms. He's a scammer. Block his calls and move on.No free lunch, and no free laptop1 -

after the repair was done i sent him videos of me driving it around and stopping and starting it to show the was no issue.
i thought he was talking specifically about that original issue I had fixed, but looking back now I read it in a different way, it’s almost like he was asking for a blanket guarantee in writing but I’m not stupid enough to do it.

So if you refund him and take the car back that would mean he has car hire for the price of the insurance? That's probably free if he is a trader. Nice little earner if it works for him.1

It's sad that people like this 'trader' are still around and I'm never lucky enough to meet one. I say lucky as in all the cars/bikes I've bought and sold over the years (I'm no trader by the way) I've always had good transactions with both parties leaving happy BUT if somebody like this so called 'trader' tried that trick with me, they would really really regret it lol.
You say your an honest person OP and you do come across that way, you couldn't have done any more than you did, just accept that people like this trader do exist like I say sad but unfortunately true, time to move on.......2
