Company gone into Administration while Furloughed

My Wife's Company has gone into Administration while she's been Furloughed and a Management buyout has taken place. She's been transferred under TUPE but they're now saying they can't continue to Furlough her, is this correct? It had been agreed she could return under a phased approach at the beginning of Aug in an Admin capacity, due to her having to help care for a very elderly relative and her role meant she would come into contact with members of the public. They've now said she has to go back next week in her normal role, which exposes her to a much higher risks of catching & passing Covid19 to her vulnerable relative who she's helping to care for. Can they do this?

Until there's a vaccine available what does your wife intend to do? The choice is hers. The new Company needs to get up and running in order to stand any chance of survival itself. .1

Baffling the number of people who think they now have the right to toss off working again until there are 0 cases of this or a vaccine.0

TUPE was originally a grey area but has since been clarified.
Read the section called "Employee transfers under TUPE and on a change in ownership" on https://www.gov.uk/guidance/check-which-employees-you-can-put-on-furlough-to-use-the-coronavirus-job-retention-scheme and perhaps share it with the employer
Ultimately though it's the employers choice whether they claim furlough for your wife1 -
ask if they will stick to the same plan if they won't say not a problem and go back to workReat21 said:My Wife's Company has gone into Administration while she's been Furloughed and a Management buyout has taken place. Lots of people have worked all through lockdown and they live with extremely vulnerable people, there's a few that post regular on here. It can be done but she will need to stick to strict hygeine rules when returning from work. This virus isn't going to go away overnight and we are going to have to live a new "normal" for quite sometime.
