I note that someone said above that charging these fees is a criminal offence. I haven't checked the detail, but I suspect that this might not be correct: I find it more likely that it's a civil offence (different enforcement and potential penalties). I really can't, for example, see the police getting involved in a situation like this.

Yes poor wording by me in earlier post it would be a civil offence. You wouldn’t expect police involvement but some local trading standards departments have been quite aggressive in prosecuting companies flouting the law on this.
