Close bank account

Hi if my chargeback is successful and I cancel my debit card after can they try and claim it back?

    Yes. They have 45 days to do so. Closing the account won't avoid that. The bank may even say you cant close the account until 45 days have passed anyway.

    You'll owe the bank a debt.

    Make sure you settle it quickly to avoid charges and credit file impacts.

  • Chargeback does not end the process, the company you have the chargeback issued against can pursue you through the courts to recover the money, even after the 45 day dispute period on the chargeback.

    If you are as you seem fairly certain that the chargeback will be reversed then I would suggest you seriously consider what you are doing, by issuing a chargeback and trying to avoid the return (eg removing all the money from your account) you could find you have a CCJ issued against you by the bank, if you do not have solid grounds to recover the funds then the company could also pursue through the courts and gain a CCJ. 

    Chargeback is a perfectly legitimate method of recovering funds, but you also have to make sure you are recovering the funds in a way that is consistent with the law.

    Hi yes I'm definitely entitled to the charge back loveholidays have not refunded me for a cancellation and after nearly 4 months of waiting my argument is this is my money and loveholidays are acting illegally so when I finally get my money through the chargeback I'm guessing they will dispute it as they've acted fraudulent from the start and just reading this forum confirms this is happening I just want the fight to end and get the money I am legally owed. I am dealing with a company that is acting so wrongly and the fact  me getting my chargeback which actually says loveholidays are in the wrong otherwise I wouldn't get it in just looking for ways to hold on to it they haven't played fairly why should I?

    i doubt your bank would see it the same way. If they let you close the account they can start proceedings against you to recover money should Love Holidays pull it back within 45 days.

    If you choose to ignore this advice, so be it.

    That's not what it says at all.

    Any strategy that involves you trying to avoid repaying a valid debt is going to cost you much, much more in the long run.
