Section 75

I brought a claim to section 75 over a year ago which was regected so I took the case to the ombudsman,and won my case I was awarded almost £2,000 for damage to my garden and flooring.which section 75 paid. I was also awarded a replacement conservatory and the foundations/base to be re built. The conservatory company have said they will re build the base and foundations.then re build our original conservatory.i told them the ruling I have is for a replacement conservatory not this one back that is defective.there reply is your ruling is against the Halifax not pennine that’s all we are doing.can I now go back to section 75 and demand my money back. The ruling I have was agreed by section 75 over 16 weeks ago.

    "Section 75" is a claim under teh Consumer Credit Act against your credit provider, presumably Halifax, since that's the only bank you've mentioned.
    It is nothing at all to do with whoever is building the conservatory.
    If you have a problem, talk to the bank.
    If it sticks, force it.
    If it breaks, well it wasn't working right anyway.

    Who's instructed the company for the replacement conservatory? Halifax? Did you have input on the company or did they choose it themselves etc?
  • Pennine built it and the instructions from the ombudsman was that section 75 must instruct pennine to re-do the base and foundations then erect a replacement structure.pennine will only take down the existing structure re-do the base/foundations and re erect the structure.ive read if you can’t get section 75 to do what’s instructed in the ruling to instruct bailiffs. I’m guessing for the sum the conservatory cost.
