Letters TO PPC's and ...... so called Legals ?

Coupon-mad has put to me that their could be confusion as to the result of sending letters as seen in this thread.

These letters are NOT a magic wand just as the legals have no magic wand

UNDERSTANDING THE HISTORY
For a couple of years now, the legals have been adding fake amounts to their claim, normally £60 ?
This was started by one legal and the rest followed like Lemmings.  We could argue that the fake amounts were against the ruling in the Supreme court, POFA2012 and the county courts own ruling of double recovery but, the defendant was always relying on the judge fully undestanding this. Sad to say that many judges did not understand.

Then in 2019 in the Southampton court, BWLegal claimed against  CEC16  who came to this forum help.  The claim included a false £60. and CEC16 waited for his day in court.  It never happened because Judge Taylor at Southampton court ruled that the BWLegal claim was an ABUSE OF PROCESS and struck out the claim.  BWLegal did not accept this and appealed.  There was a further case and BWLegal sent a Barrister along as they clearly thought they were right. Little did they know that Coupon-mad (MSE Star member), was also on her way.  On her train journey she came across the Consumer Rights Act 2015

The Judge presiding was DDJ Grand and despite arguments from the barrister, Coupon-mad won the day and the introduction of the Consumer Rights Act 2015 was now a major part in the £60 scam
BWLEGAL LOST and ABUSE OF PROCESS was born 

The rulings of Judge Taylor and Judge Grand have spread around the country and now many courts strike out such cases as Abuse of process.  Truro county court have said that they systematically strike out such fake claims
BUT ,,,, There are still judges who do not understand this and it does not follow that by reading your WS,  they will automatically strike out the case.  Maybe they have not read it properly, difficult to know but it is your job to make them understand   

The robo claim legals rubber stamp their claim with a fake £60, they are scamming you and the courts despite being constantly told 

THE LETTERS:
Asking them what legal authority they have to add £60 will either be responded to with nonsensical rubbish as we often see here, or they will not respond.  .  THEY SIMPLY CANNOT PROVIDE PROOF OF THEIR LEGAL AUTHORITY and if they do reply, expect to see such rubbish that they are allowed by the code practice.   This is a huge joke because both codes of practice are an invention to enable parking companies and legals to make extra money, it is unlawful and is totally against The Supreme Court, POFA2012 and the courts own ruling of double recovery and the Consumer Rights Act 2015

So, if you get a reply to your letter with no proof of their legal authority, you can then show the judge a copy of your letter and ask the claimant (normally represented by a (hire by the hour legal) to explain this with a question mark look at the judge.
If they do not reply, you still have the letter to show the judge for the very same question.
This should alert the judge about how unreliable the case is. What the Judge decides to do is of course up to the Judge.  You have therefore raised the stakes to a high level and hopefully close enough to get the case struck out for Abuse of process
