To ho back to the original question, she may have owned the path because she was the first house to buy it and kicked up a fuss unless it was included in her plot.
Or she may have been the last house to buy and the developer realised that they didn't want to be left owning it.
Alternatively, the original design may have been for number 1&2 to have a path to the left and 3&4 to the right but someone messed up the plans/deeds for number 1
