Had the agent been notified? Any agency they had for your MIL would have ended upon her death. They should agree a new contract with the executor/beneficiary.
Depends if the contract accounted for the situation,
My mortgage contract has clauses that binds my estate to the same terms that I agreed to.

I don't recommend joint accounts unless compelling reasons,  they create a financial link best avoided.

Surely not if it's an executor's account?

Don't understand your point in posting this.

Your mortgage company aren't an agent. The beneficiaries couldn't be bound by someone else (unless that party had agency for them) and wouldn't have been able to enter a rental agreement until they had interest in the property (because you can't give what you yourself don't have).
You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride

    The beneficiaries are irelevent initially

The estate  is held as a trust by the admistrators and are bound by the contractual term of any agreement of the deceased.

My experience with Barclays is that they do stop and return payments in but it might take a few days after they have been informed (everything is slower than normal due to COViD).
the good news is that Barclays will release up to £50k without probate.

My father passed away 5 weeks ago leaving my mother 76 years old. Most banks and credit card Co's have been helpful with bereavement depts getting deaths Certs etc... Marks & Spencers are by far the worst, the most disgusting, bear in mind that my fathers credit card acct with M&S was in his name alone NOT joint are anything to do with my mother, yet, M&S are demanding my mother is liable AND she is to complete an assets and liability form, if she does not complete the assets & liabilities form ( of herself) they threaten to send for debt collectors. My mother is besides herself with worry.....

Hi - you've posted this on to two existing threads. What you needed to do was start one new one!
    The mods should move it.
Credit cards are always in one name only.
Who is acting as executor or personal representative? Give them the paperwork.
Whoever that is just needs to let all creditors know that they will be presented with a statement of estate when all the figures are finalised.
M&S cannot ask for preferential treatment. All non-priority creditors have to be treated equally.

I have a joint executors account with my sister which we did with HSBC as we both bank there and our late father banked there. HSBC set executors accounts up as part of their business banking service (although it's free of charge) - This executors account does not appear on my Experian credit file, and my sister does not appear as a financial link on the file either.
