Not been informed of cancellation fee

Good Morning Everyone,
A couple of days ago we booked a trip abroad. Due to work commitments we can no longer go. We we called the travel agents, they said yes ‘that is all sorted for you’ and confirmed we would be getting a cancellation email. 5-6 hours later, we received an email stating we would need to pay a further £200 to cancel the holiday due to costs incurred by the travel agents. The companies T&C’s clearly state that if the cost of cancellation is more than the deposit, then we must me informed at the time of booking; we weren’t. The problem we have is, the booking was made by an advisor at home who was dealing with us on his day off. So therefore I can imagine the phone call was not recorded. We think they will get back to us today after an ‘investigation’ saying they did. So my question is, who does the burden of proof lie with? It is much harder (near impossible) to prove something didn’t happen. We had two phone calls of 3 minutes and 5 minutes. In my opinion no where near enough time to get through everything.
