Owner didn't declare they had a business and paid rates. Council is chasing me

  • Yes we've paid council tax through the entire period we've lived here. We received no demands for non-domestic-rates until the two year period.
  • However there is a problem now that it's gone to the Magistrates court (Back in February 2020) and a liability order was issued. I only found out about this yesterday (my wife had put the letter somewhere and forgotten about it) .

If it is the debt of the previous owners then they cannot legally persure you for the debt.
  • No it was debt incurred by me because I didn't know that business rates had been continued through a change of ownership.

I don't know if you can overturn the Court decision; that's what's in play now.

Please don't drip feed information if you want help - full disclosure will be important.  No idea how you forget about an official court summons which this will have been.

Anyway you need to read the order carefully and apply for it to be set aside. Attack this on both sides - talk to the council as well as the courts. It's not your debt if what you've said is accurate.
